#2&3 are within the 3yr statue of limitations (in this state), and some soft tissue damage is hard to disprove.
That's the beauty of the american legal system. Anyone can be sued at any time, and although a successful defense might have the plaintiff pay your expenses, they never re-imburse for your time or hassle.
